1. قبول الشروط

من خلال الوصول إلى أو استخدام AiVidect ("الخدمة"، "المنصة"، "نحن"، "لدينا")، التي تديرها AiVidect، فإنك ("المستخدم"، "أنت"، "الخاص بك") توافق على الالتزام بشروط الخدمة هذه ("الشروط"). إذا كنت لا توافق على هذه الشروط، فلا يجوز لك الوصول إلى الخدمة أو استخدامها.

تشكل هذه الشروط اتفاقية ملزمة قانونياً بينك وبين AiVidect. من خلال إنشاء حساب أو شراء أرصدة أو استخدام أي ميزة من ميزات المنصة، فإنك تقر بأنك قد قرأت وفهمت ووافقت على الالتزام بهذه الشروط.

2. وصف الخدمة

توفر AiVidect خدمات تحليل الفيديو المدعومة بالذكاء الاصطناعي وكشف المحتوى المُنشأ بالذكاء الاصطناعي. تستخدم منصتنا خوارزميات التعلم الآلي لتحليل محتوى الفيديو وتقديم تقييمات المصداقية.

عروض الخدمة:

• رصيد مجاني: رصيد تحليل مجاني واحد عند تسجيل الحساب
• باقات الأرصدة: عمليات شراء لمرة واحدة متاحة (Starter, Basic, Professional, Power, Enterprise)
• الاعتمادات لا تنتهي صلاحيتها: تظل الاعتمادات المشتراة صالحة إلى أجل غير مسمى
• حدود الفيديو: فيديوهات حتى 10 دقائق، حجم الملف 500 ميجابايت
• الوصول إلى API: متاح للمستخدمين الذين لديهم أرصدة مشتراة

مهم: النتائج المقدمة من AiVidect هي تقييمات احتمالية، وليست ضمانات مطلقة. لا يجب الاعتماد فقط على خدمتنا للقرارات الحاسمة. يتم تقديم الخدمة لأغراض إعلامية فقط.

3. حسابات المستخدمين والمسؤوليات

3.1 تسجيل الحساب: للوصول إلى ميزات معينة، يجب عليك إنشاء حساب. أنت توافق على تقديم معلومات دقيقة وحالية وكاملة أثناء التسجيل.

3.2 أمان الحساب: أنت مسؤول عن الحفاظ على سرية بيانات اعتماد حسابك. أنت توافق على إخطارنا فورًا بأي وصول غير مصرح به.

3.3 الأنشطة المحظورة: لا يجوز لك:

• Upload, transmit, or analyze content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• استخدام الخدمة لإيذاء القاصرين بأي شكل
• تحميل محتوى ليس لديك الحق في استخدامه أو توزيعه
• تقديم ملاحظات خاطئة للتلاعب بمجموعات بيانات التدريب
• استخدام الخدمة لأي غرض تجاري دون إذن كتابي
• محاولة إجراء هندسة عكسية أو اكتشاف الكود المصدري
• استخدام أدوات آلية للوصول إلى الخدمة دون إذن
• التحايل على حدود المعدل أو قيود الاستخدام
• استخدام الخدمة للتنافس مع AiVidect أو بناء خدمة مماثلة

4. شراء الاعتمادات والفواتير

4.1 باقات الأرصدة: الأرصدة متاحة للشراء لمرة واحدة في حزم متنوعة. الأسعار مدرجة على صفحة التسعير.

4.2 صلاحية الأرصدة: الأرصدة المشتراة لا تنتهي صلاحيتها وتبقى في حسابك. الأرصدة غير قابلة للتحويل.

4.3 معالجة الدفع: تتم معالجة جميع المدفوعات بشكل آمن عبر Stripe. من خلال الشراء، فإنك تفوضنا بالخصم.

4.4 استخدام الأرصدة: يستهلك كل تحليل فيديو رصيدًا واحدًا. يتم خصم الأرصدة عند تقديم التحليل.

4.5 أرصدة الإحالة: يمكنك كسب أرصدة إضافية من خلال برنامج الإحالة. تخضع لنفس شروط الأرصدة المشتراة.

5. سياسة عدم الاسترداد

جميع المبيعات نهائية. لن يتم إصدار أي استرداد لأي سبب من الأسباب، بما في ذلك على سبيل المثال لا الحصر:

• عدم الرضا عن نتائج الخدمة أو دقتها
• عدم استخدام الأرصدة المشتراة
• تعليق الحساب أو إنهائه بسبب انتهاك هذه الشروط
• مشاكل تقنية أو انقطاع الخدمة أو التوقف
• Change of mind or buyer's remorse
• الاستخدام الجزئي للأرصدة المشتراة
• الأرصدة غير المستخدمة أو استدعاءات API أو الميزات

By purchasing any credit package, you explicitly acknowledge and agree to this No Refund Policy. We strongly encourage you to use your free credit before purchasing additional credits.

رد المبالغ المدفوعة: If you initiate a chargeback or payment dispute without attempting to resolve the issue with us first, we reserve the right to immediately terminate your account and pursue legal remedies to recover costs and damages.

6. حقوق الملكية الفكرية

6.1 ملكية AiVidect: The Service, including all content, features, functionality, source code, algorithms, designs, and trademarks, is owned by AiVidect and is protected by international copyright, trademark, and other intellectual property laws.

6.2 محتواك: You retain ownership of any content you upload to the Service. By uploading content, you grant us a limited license to process and analyze your content solely to provide the Service.

• بدون تخزين: نحن لا نخزن أو نحتفظ بأي نسخة من مقاطع الفيديو الخاصة بك
• بدون بيانات تدريب: لا يتم جمع مقاطع الفيديو أو استخدامها لتدريب النماذج
• الخصوصية: يظل محتوى الفيديو الخاص بك خاصًا تمامًا ولا يتم تخزينه أبدًا على خوادمنا

نتائج التحليل: قد يتم تخزين نتائج التحليل مؤقتًا وربطها بحسابك للرجوع إليها.

7. إخلاء المسؤولية والقيود

7.1 الخدمة "كما هي": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 لا ضمان للدقة: We do not guarantee the accuracy, reliability, or completeness of any analysis results. AI/ML systems can produce false positives and false negatives. You should not rely solely on our Service for critical decisions.

7.3 حدود المسؤولية: TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIVIDECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

7.4 الحد الأقصى للمسؤولية: In no event shall AiVidect's total liability to you for all damages exceed the amount you paid to AiVidect in the six (6) months preceding the claim, or $100 USD, whichever is less.

8. التعويض

You agree to indemnify, defend, and hold harmless AiVidect, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

9. الإنهاء

9.1 من جانبك: You may terminate your account at any time by contacting us or through your account settings. Upon termination, any unused credits will be forfeited.

9.2 من جانبنا: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination by us for cause, you forfeit any remaining credits and no refund will be issued.

9.3 أثر الإنهاء: Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnity, and limitations of liability.

10. حل النزاعات والتحكيم

10.1 الحل غير الرسمي: Before filing a claim, you agree to contact us at support@aividect.com and attempt to resolve the dispute informally for at least 30 days.

10.2 التحكيم الملزم: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English in the United States.

10.3 التنازل عن الدعوى الجماعية: YOU AND AIVIDECT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

10.4 الاستثناءات: Either party may seek equitable relief in court for infringement of intellectual property rights.

11. القانون الحاكم والاختصاص القضائي

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.

12. التغييرات في الشروط

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

13. الخصوصية

14. متفرقات

14.1 الاتفاقية الكاملة: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AiVidect regarding the Service.

14.3 التنازل: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

14.5 القوة القاهرة: We shall not be liable for any failure to perform our obligations where such failure results from causes beyond our reasonable control.
