1. Aceptación de los Términos

Al acceder o utilizar AiVidect ("Servicio", "Plataforma", "nosotros", "nuestro"), operado por AiVidect, usted ("Usuario", "usted", "su") acepta estar sujeto a estos Términos de Servicio ("Términos"). Si no está de acuerdo con estos Términos, no puede acceder ni utilizar el Servicio.

Estos Términos constituyen un acuerdo legalmente vinculante entre usted y AiVidect. Al crear una cuenta, comprar créditos o utilizar cualquier función de la Plataforma, usted reconoce que ha leído, entendido y acepta estar sujeto a estos Términos.

2. Descripción del Servicio

AiVidect proporciona servicios de análisis de video impulsados por IA y detección de contenido generado por IA. Nuestra Plataforma utiliza algoritmos de aprendizaje automático para analizar el contenido de video y proporcionar evaluaciones de autenticidad.

• Paquetes de Créditos: Compras únicas disponibles (Starter, Basic, Professional, Power, Enterprise)
• Los Créditos Nunca Expiran: Los créditos comprados permanecen válidos indefinidamenteSi tienes problemas para verificar tu cuenta, por favor contacta a nuestro equipo de soporte.
• Límites de Video: Videos de hasta 10 minutos, tamaño de archivo de 500MB
• Acceso API: Disponible para usuarios con créditos comprados

Importante: Los resultados proporcionados por AiVidect son evaluaciones probabilísticas, no garantías absolutas. No debe confiar únicamente en nuestro Servicio para decisiones críticas. El Servicio se proporciona únicamente con fines informativos.

3. Cuentas de Usuario y Responsabilidades

3.1 Registro de Cuenta: Para acceder a ciertas funciones, debe crear una cuenta. Acepta proporcionar información precisa, actual y completa durante el registro y actualizar dicha información según sea necesario.

3.2 Seguridad de la Cuenta: Usted es responsable de mantener la confidencialidad de las credenciales de su cuenta. Acepta notificarnos inmediatamente de cualquier acceso o uso no autorizado de su cuenta.

3.3 Actividades Prohibidas: Usted no puede:

• Upload, transmit, or analyze content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• Usar el Servicio para dañar a menores de cualquier manera
• Cargar contenido que no tiene derecho a usar o distribuir
• Enviar comentarios falsos o engañosos para manipular nuestros conjuntos de datos de entrenamiento
• Usar el Servicio para cualquier propósito comercial sin nuestro permiso expreso por escrito
• Intentar realizar ingeniería inversa, descompilar o descubrir el código fuente del Servicio
• Usar herramientas automatizadas (bots, scrapers) para acceder al Servicio sin permiso
• Eludir cualquier límite de velocidad o restricciones de uso
• Usar el Servicio para competir con AiVidect o construir un servicio similar

4. Compra de Créditos y Facturación

4.1 Paquetes de Créditos: Los créditos están disponibles para compra única en varios paquetes. Los precios están en nuestra página de Precios.

4.2 Validez de los Créditos: Los créditos comprados nunca expiran y permanecen en su cuenta hasta que se utilicen. Los créditos no son transferibles.

4.3 Procesamiento de Pagos: Todos los pagos se procesan de forma segura a través de Stripe. Al comprar créditos, nos autoriza a cobrar.

4.4 Uso de Créditos: Cada análisis de video consume un crédito. Los créditos se deducen al enviar el análisis.

4.5 Créditos de Referencia: Puede ganar créditos de bonificación a través de nuestro programa de referidos. Los créditos de referencia tienen los mismos términos.

5. POLÍTICA DE NO REEMBOLSO

TODAS LAS VENTAS SON FINALES. NO SE EMITIRÁN REEMBOLSOS POR NINGÚN MOTIVO, INCLUYENDO PERO NO LIMITADO A:

• Insatisfacción con los resultados o precisión del servicio
• No utilizar los créditos comprados
• Suspensión o terminación de la cuenta por violación de estos Términos
• Problemas técnicos, interrupciones del servicio o tiempo de inactividad
• Change of mind or buyer's remorse
• Uso parcial de los créditos comprados
• Créditos no utilizados, llamadas API o funciones

By purchasing any credit package, you explicitly acknowledge and agree to this No Refund Policy. We strongly encourage you to use your free credit before purchasing additional credits.

Contracargos: If you initiate a chargeback or payment dispute without attempting to resolve the issue with us first, we reserve the right to immediately terminate your account and pursue legal remedies to recover costs and damages.

6. Derechos de Propiedad Intelectual

6.1 Propiedad de AiVidect: The Service, including all content, features, functionality, source code, algorithms, designs, and trademarks, is owned by AiVidect and is protected by international copyright, trademark, and other intellectual property laws.

6.2 Su Contenido: You retain ownership of any content you upload to the Service. By uploading content, you grant us a limited license to process and analyze your content solely to provide the Service.

6.3 Manejo de Videos:

• Sin Retención: Los videos cargados se procesan y se eliminan inmediatamente después del análisis
• Sin Almacenamiento: NO almacenamos, retenemos ni guardamos ninguna copia de sus videos
• Sin Datos de Entrenamiento: Los videos NO se recopilan ni se utilizan para el entrenamiento de modelos
• Privacidad: Su contenido de video permanece completamente privado y nunca se almacena en nuestros servidores

Resultados del Análisis: Los resultados del análisis pueden almacenarse en caché y vincularse a su cuenta para referencia histórica.

7. Descargos de Responsabilidad y Limitaciones

7.1 Servicio "Tal Cual": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Sin Garantía de Precisión: We do not guarantee the accuracy, reliability, or completeness of any analysis results. AI/ML systems can produce false positives and false negatives. You should not rely solely on our Service for critical decisions.

7.3 Limitación de Responsabilidad: TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIVIDECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Su uso o incapacidad para usar el Servicio
• Resultados de análisis inexactos o determinaciones falsas
• Acceso no autorizado o alteración de sus transmisiones o datos
• Interrupciones del servicio o errores
• Cualquier dependencia del contenido o análisis obtenido a través del Servicio

7.4 Responsabilidad Máxima: In no event shall AiVidect's total liability to you for all damages exceed the amount you paid to AiVidect in the six (6) months preceding the claim, or $100 USD, whichever is less.

8. Indemnización

You agree to indemnify, defend, and hold harmless AiVidect, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

9. Terminación

9.1 Por Usted: You may terminate your account at any time by contacting us or through your account settings. Upon termination, any unused credits will be forfeited.

9.2 Por Nosotros: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination by us for cause, you forfeit any remaining credits and no refund will be issued.

9.3 Efecto de la Terminación: Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnity, and limitations of liability.

10. Resolución de Disputas y Arbitraje

10.1 Resolución Informal: Before filing a claim, you agree to contact us at support@aividect.com and attempt to resolve the dispute informally for at least 30 days.

10.2 Arbitraje Vinculante: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English in the United States.

10.3 Renuncia a Demanda Colectiva: YOU AND AIVIDECT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

10.4 Excepciones: Either party may seek equitable relief in court for infringement of intellectual property rights.

11. Ley Aplicable y Jurisdicción

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.

12. Cambios en los Términos

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

Cambios Materiales: For material changes (such as price increases or significant service modifications), we will provide at least 30 days' advance notice via email.

13. Privacidad

14. Misceláneos

14.1 Acuerdo Completo: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AiVidect regarding the Service.

14.3 Renuncia: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

14.4 Cesión: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 Fuerza Mayor: We shall not be liable for any failure to perform our obligations where such failure results from causes beyond our reasonable control.
