En accédant ou en utilisant AiVidect ("Service", "Plateforme", "nous", "notre"), exploité par AiVidect, vous ("Utilisateur", "vous", "votre") acceptez d'être lié par ces Conditions d'Utilisation ("Conditions"). Si vous n'acceptez pas ces Conditions, vous ne pouvez pas accéder ou utiliser le Service.

Ces Conditions constituent un accord juridiquement contraignant entre vous et AiVidect. En créant un compte, en achetant des crédits ou en utilisant toute fonctionnalité de la Plateforme, vous reconnaissez avoir lu, compris et accepté d'être lié par ces Conditions.

2. Description du Service

AiVidect fournit des services d'analyse vidéo alimentés par l'IA et de détection de contenu généré par l'IA. Notre Plateforme utilise des algorithmes d'apprentissage automatique pour analyser le contenu vidéo et fournir des évaluations d'authenticité.

• Limites Vidéo: Vidéos jusqu'à 10 minutes, taille de fichier de 500MB

Important: Les résultats fournis par AiVidect sont des évaluations probabilistes, pas des garanties absolues. Vous ne devez pas vous fier uniquement à notre Service pour des décisions critiques. Le Service est fourni à titre informatif uniquement.

3. Comptes Utilisateur et Responsabilités

3.1 Inscription au Compte: Pour accéder à certaines fonctionnalités, vous devez créer un compte. Vous acceptez de fournir des informations exactes, actuelles et complètes lors de l'inscription.

3.2 Sécurité du Compte: Vous êtes responsable du maintien de la confidentialité des identifiants de votre compte. Vous acceptez de nous notifier immédiatement tout accès ou utilisation non autorisé.

3.3 Activités Interdites: Vous ne pouvez pas:

• Upload, transmit, or analyze content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy

• Soumettre des commentaires faux ou trompeurs pour manipuler nos ensembles de données
• Utiliser le Service à des fins commerciales sans notre autorisation écrite
• Tenter de faire de l'ingénierie inverse ou de découvrir le code source du Service
• Utiliser des outils automatisés pour accéder au Service sans autorisation
• Contourner les limites de débit ou les restrictions d'utilisation
• Utiliser le Service pour concurrencer AiVidect ou créer un service similaire

4. Achats de Crédits et Facturation

4.1 Forfaits de Crédits: Les crédits sont disponibles à l'achat unique en différents forfaits. Les prix sont sur notre page Tarifs.

4.2 Validité des Crédits: Les crédits achetés n'expirent jamais et restent sur votre compte. Les crédits ne sont pas transférables.

4.3 Traitement des Paiements: Tous les paiements sont traités de manière sécurisée via Stripe. En achetant, vous nous autorisez à débiter.

4.4 Utilisation des Crédits: Chaque analyse vidéo consomme un crédit. Les crédits sont déduits lors de la soumission.

4.5 Crédits de Parrainage: Vous pouvez gagner des crédits bonus grâce à notre programme de parrainage. Mêmes conditions que les crédits achetés.

5. POLITIQUE DE NON-REMBOURSEMENT

TOUTES LES VENTES SONT DÉFINITIVES. AUCUN REMBOURSEMENT NE SERA EFFECTUÉ POUR QUELQUE RAISON QUE CE SOIT, Y COMPRIS MAIS SANS S'Y LIMITER:

• Insatisfaction quant aux résultats ou à la précision du service
• Non-utilisation des crédits achetés
• Suspension ou résiliation du compte pour violation de ces Conditions
• Problèmes techniques, interruptions de service ou temps d'arrêt
• Change of mind or buyer's remorse
• Utilisation partielle des crédits achetés
• Crédits non utilisés, appels API ou fonctionnalités

By purchasing any credit package, you explicitly acknowledge and agree to this No Refund Policy. We strongly encourage you to use your free credit before purchasing additional credits.

Rétrofacturations: If you initiate a chargeback or payment dispute without attempting to resolve the issue with us first, we reserve the right to immediately terminate your account and pursue legal remedies to recover costs and damages.

6.2 Votre Contenu: You retain ownership of any content you upload to the Service. By uploading content, you grant us a limited license to process and analyze your content solely to provide the Service.

6.3 Gestion des Vidéos:

• Aucune Rétention: Les vidéos téléchargées sont traitées et immédiatement supprimées après l'analyse
• Aucun Stockage: Nous ne stockons, ne conservons ni ne gardons aucune copie de vos vidéos
• Aucune Donnée d'Entraînement: Les vidéos ne sont PAS collectées ni utilisées pour l'entraînement des modèles
• Confidentialité: Votre contenu vidéo reste entièrement privé et n'est jamais stocké sur nos serveurs

Résultats d'Analyse: Les résultats d'analyse peuvent être mis en cache et liés à votre compte pour référence historique.

7. Avertissements et Limitations de Responsabilité

7.1 Service "Tel Quel": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 Aucune Garantie de Précision: We do not guarantee the accuracy, reliability, or completeness of any analysis results. AI/ML systems can produce false positives and false negatives. You should not rely solely on our Service for critical decisions.

7.3 Limitation de Responsabilité: TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIVIDECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• Votre utilisation ou incapacité à utiliser le Service

7.4 Responsabilité Maximale: In no event shall AiVidect's total liability to you for all damages exceed the amount you paid to AiVidect in the six (6) months preceding the claim, or $100 USD, whichever is less.

8. Indemnisation

You agree to indemnify, defend, and hold harmless AiVidect, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

9. Résiliation

9.1 Par Vous: You may terminate your account at any time by contacting us or through your account settings. Upon termination, any unused credits will be forfeited.

9.2 Par Nous: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination by us for cause, you forfeit any remaining credits and no refund will be issued.

10.2 Arbitrage Contraignant: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English in the United States.

10.3 Renonciation aux Actions Collectives: YOU AND AIVIDECT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

10.4 Exceptions: Either party may seek equitable relief in court for infringement of intellectual property rights.

11. Droit Applicable et Juridiction

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.
