1. शर्तों की स्वीकृति

AiVidect ("सेवा", "प्लेटफ़ॉर्म", "हम", "हमारा") तक पहुंचने या उपयोग करके, जो AiVidect द्वारा संचालित है, आप ("उपयोगकर्ता", "आप", "आपका") इन सेवा की शर्तों ("शर्तें") से बंधे रहने के लिए सहमत हैं। यदि आप इन शर्तों से सहमत नहीं हैं, तो आप सेवा तक नहीं पहुंच सकते या उपयोग नहीं कर सकते।

2. सेवा विवरण

AiVidect AI-संचालित वीडियो विश्लेषण और AI-जनित सामग्री पहचान सेवाएं प्रदान करता है। हमारा प्लेटफ़ॉर्म वीडियो सामग्री का विश्लेषण करने और प्रामाणिकता मूल्यांकन प्रदान करने के लिए मशीन लर्निंग एल्गोरिदम का उपयोग करता है।

सेवा प्रस्ताव:

• मुफ्त क्रेडिट: खाता पंजीकरण पर 1 मुफ्त विश्लेषण क्रेडिट
• क्रेडिट पैकेज: एक बार की खरीद उपलब्ध (Starter, Basic, Professional, Power, Enterprise)

3. उपयोगकर्ता खाते और जिम्मेदारियां

• Upload, transmit, or analyze content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy

• दर सीमा या उपयोग प्रतिबंधों को दरकिनार करना
• AiVidect के साथ प्रतिस्पर्धा करने के लिए सेवा का उपयोग करना

4. क्रेडिट खरीद और बिलिंग

4.1 क्रेडिट पैकेज: क्रेडिट विभिन्न पैकेजों में एक बार की खरीद के लिए उपलब्ध हैं। कीमतें मूल्य निर्धारण पृष्ठ पर सूचीबद्ध हैं।

4.2 क्रेडिट वैधता: खरीदे गए क्रेडिट कभी समाप्त नहीं होते और आपके खाते में रहते हैं। क्रेडिट हस्तांतरणीय नहीं हैं।

4.3 भुगतान प्रसंस्करण: सभी भुगतान Stripe के माध्यम से सुरक्षित रूप से संसाधित किए जाते हैं। क्रेडिट खरीदकर, आप हमें अधिकृत करते हैं।

4.4 क्रेडिट उपयोग: प्रत्येक वीडियो विश्लेषण एक क्रेडिट का उपभोग करता है। विश्लेषण जमा करने पर क्रेडिट काटे जाते हैं।

4.5 रेफरल क्रेडिट: आप रेफरल प्रोग्राम के माध्यम से बोनस क्रेडिट अर्जित कर सकते हैं। समान शर्तें लागू होती हैं।

5. धनवापसी नहीं की नीति

सभी बिक्री अंतिम हैं। किसी भी कारण से रिफंड जारी नहीं किया जाएगा, जिसमें शामिल हैं लेकिन इन तक सीमित नहीं:

• सेवा परिणामों या सटीकता से असंतुष्टि
• खरीदे गए क्रेडिट का उपयोग न करना

• तकनीकी समस्याएं, सेवा में रुकावट, या डाउनटाइम
• Change of mind or buyer's remorse

By purchasing any credit package, you explicitly acknowledge and agree to this No Refund Policy. We strongly encourage you to use your free credit before purchasing additional credits.

चार्जबैक: If you initiate a chargeback or payment dispute without attempting to resolve the issue with us first, we reserve the right to immediately terminate your account and pursue legal remedies to recover costs and damages.

6. बौद्धिक संपदा अधिकार

6.1 AiVidect संपत्ति: The Service, including all content, features, functionality, source code, algorithms, designs, and trademarks, is owned by AiVidect and is protected by international copyright, trademark, and other intellectual property laws.

6.2 आपकी सामग्री: You retain ownership of any content you upload to the Service. By uploading content, you grant us a limited license to process and analyze your content solely to provide the Service.

7. अस्वीकरण और दायित्व की सीमाएं

7.1 सेवा "जैसी है": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.4 अधिकतम दायित्व: In no event shall AiVidect's total liability to you for all damages exceed the amount you paid to AiVidect in the six (6) months preceding the claim, or $100 USD, whichever is less.

You agree to indemnify, defend, and hold harmless AiVidect, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

9.1 आपके द्वारा: You may terminate your account at any time by contacting us or through your account settings. Upon termination, any unused credits will be forfeited.

9.2 हमारे द्वारा: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination by us for cause, you forfeit any remaining credits and no refund will be issued.

10. विवाद समाधान और मध्यस्थता

10.1 अनौपचारिक समाधान: Before filing a claim, you agree to contact us at support@aividect.com and attempt to resolve the dispute informally for at least 30 days.

10.2 बाध्यकारी मध्यस्थता: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English in the United States.

10.3 सामूहिक कार्रवाई छूट: YOU AND AIVIDECT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

10.4 अपवाद: Either party may seek equitable relief in court for infringement of intellectual property rights.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
