1. 利用規約への同意

AiVidect（「サービス」、「プラットフォーム」、「当社」、「私たち」）にアクセスまたは使用することにより、お客様（「ユーザー」、「あなた」、「お客様の」）は、本利用規約（「規約」）に拘束されることに同意するものとします。本規約に同意しない場合、サービスにアクセスまたは使用することはできません。

本規約は、お客様とAiVidectとの間の法的拘束力のある契約を構成します。アカウントを作成、クレジットを購入、またはプラットフォームの機能を使用することにより、お客様は本規約を読み、理解し、これに拘束されることに同意したことを認めます。

2. サービスの説明

AiVidectは、AI搭載のビデオ分析およびAI生成コンテンツ検出サービスを提供しています。当社のプラットフォームは、機械学習アルゴリズムを使用してビデオコンテンツを分析し、真正性の評価を提供します。

サービス内容:

• 無料クレジット: アカウント登録時に1回の無料分析クレジット
• クレジットパッケージ: 一回限りの購入可能（Starter、Basic、Professional、Power、Enterprise）
• クレジットは期限切れなし：購入したクレジットは無期限に有効です
• ビデオ制限: 最大10分の動画、500MBのファイルサイズ
• APIアクセス: クレジットを購入したユーザーが利用可能

重要: AiVidectが提供する結果は確率的評価であり、絶対的な保証ではありません。重要な決定に当社のサービスのみに依存すべきではありません。本サービスは情報提供のみを目的としています。

3. ユーザーアカウントと責任

3.1 アカウント登録: 特定の機能にアクセスするには、アカウントを作成する必要があります。登録時に正確で最新かつ完全な情報を提供し、必要に応じてその情報を更新することに同意するものとします。

3.2 アカウントセキュリティ: お客様は、アカウント資格情報の機密性を維持する責任があります。アカウントへの不正アクセスまたは不正使用があった場合は、直ちに当社に通知することに同意するものとします。

3.3 禁止事項: 以下の行為は禁止されています:

• Upload, transmit, or analyze content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• 未成年者に何らかの形で害を与えるためにサービスを使用すること
• 使用または配布する権利がないコンテンツをアップロードすること
• トレーニングデータセットを操作するために虚偽または誤解を招くフィードバックを送信すること
• 当社の明示的な書面による許可なく、商業目的でサービスを使用すること
• サービスのソースコードをリバースエンジニアリング、逆コンパイル、または発見しようとすること
• 許可なく自動化ツール（ボット、スクレイパー）を使用してサービスにアクセスすること
• レート制限または使用制限を回避すること
• AiVidectと競合するため、または同様のサービスを構築するためにサービスを使用すること

4. クレジット購入と請求

4.1 クレジットパッケージ: クレジットは、さまざまなパッケージで一回限りの購入が可能です。価格は料金ページに記載されており、通知により変更される場合があります。

4.2 クレジットの有効期間: 購入したクレジットは期限切れになることはなく、使用されるまでアカウントに残ります。クレジットはアカウント間で譲渡できません。

4.3 支払い処理: すべての支払いはStripeを通じて安全に処理されます。クレジットを購入することにより、選択したパッケージの支払いを承認します。

4.4 クレジットの使用: 各動画分析は、アカウント残高から1クレジットを消費します。クレジットは分析提出時に差し引かれます。

4.5 紹介クレジット: 紹介プログラムを通じてボーナスクレジットを獲得できます。紹介クレジットは購入したクレジットと同じ条件に従います。

5. 返金不可ポリシー

すべての販売は最終的なものです。以下を含むがこれらに限定されない、いかなる理由においても返金は行われません:

• サービス結果や精度への不満
• 購入したクレジットを使用しないこと
• これらの規約違反によるアカウントの停止または終了
• 技術的な問題、サービスの中断、またはダウンタイム
• Change of mind or buyer's remorse
• 購入したクレジットの部分的な使用
• 未使用のクレジット、API呼び出し、または機能

By purchasing any credit package, you explicitly acknowledge and agree to this No Refund Policy. We strongly encourage you to use your free credit before purchasing additional credits.

チャージバック: If you initiate a chargeback or payment dispute without attempting to resolve the issue with us first, we reserve the right to immediately terminate your account and pursue legal remedies to recover costs and damages.

6. 知的財産権

6.1 AiVidectの財産: The Service, including all content, features, functionality, source code, algorithms, designs, and trademarks, is owned by AiVidect and is protected by international copyright, trademark, and other intellectual property laws.

6.2 お客様のコンテンツ: You retain ownership of any content you upload to the Service. By uploading content, you grant us a limited license to process and analyze your content solely to provide the Service.

6.3 動画の取り扱い:

• 保持なし: アップロードされた動画は処理され、分析完了後すぐに削除されます
• 保存なし: お客様の動画のコピーを保存、保持、または保管することはありません
• トレーニングデータなし: 動画はモデルのトレーニングのために収集または使用されません
• プライバシー: お客様の動画コンテンツは完全にプライベートなままであり、当社のサーバーに保存されることはありません

分析結果: 分析結果は、パフォーマンス目的でキャッシュされ、履歴参照のためにアカウントにリンクされる場合があります。

7. 免責事項と責任の制限

7.1 サービス「現状有姿」: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 精度の保証なし: We do not guarantee the accuracy, reliability, or completeness of any analysis results. AI/ML systems can produce false positives and false negatives. You should not rely solely on our Service for critical decisions.

7.3 責任の制限: TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIVIDECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

7.4 最大責任額: In no event shall AiVidect's total liability to you for all damages exceed the amount you paid to AiVidect in the six (6) months preceding the claim, or $100 USD, whichever is less.

8. 補償

You agree to indemnify, defend, and hold harmless AiVidect, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

9. 終了

9.1 お客様による解約: You may terminate your account at any time by contacting us or through your account settings. Upon termination, any unused credits will be forfeited.

9.2 当社による解約: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination by us for cause, you forfeit any remaining credits and no refund will be issued.

9.3 解約の効果: Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnity, and limitations of liability.

10. 紛争解決と仲裁

10.1 非公式な解決: Before filing a claim, you agree to contact us at support@aividect.com and attempt to resolve the dispute informally for at least 30 days.

10.2 拘束力のある仲裁: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English in the United States.

10.3 集団訴訟の放棄: YOU AND AIVIDECT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

10.4 例外: Either party may seek equitable relief in court for infringement of intellectual property rights.

11. 準拠法と裁判管轄

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.

12. 規約の変更

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

14.1 完全な合意: These Terms, together with our Privacy Policy, constitute the entire agreement between you and AiVidect regarding the Service.

14.3 権利放棄: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

14.4 譲渡: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 不可抗力: We shall not be liable for any failure to perform our obligations where such failure results from causes beyond our reasonable control.
