AiVidect("서비스", "플랫폼", "당사", "우리")에 접근하거나 사용함으로써 귀하("사용자", "귀하", "귀하의")는 본 서비스 약관("약관")에 구속되는 것에 동의합니다. 본 약관에 동의하지 않는 경우 서비스에 접근하거나 사용할 수 없습니다.

본 약관은 귀하와 AiVidect 간의 법적 구속력이 있는 계약을 구성합니다. 계정을 생성하거나 크레딧을 구매하거나 플랫폼의 기능을 사용함으로써 귀하는 본 약관을 읽고 이해했으며 이에 구속되는 것에 동의함을 인정합니다.

2. 서비스 설명

AiVidect는 AI 기반 비디오 분석 및 AI 생성 콘텐츠 감지 서비스를 제공합니다. 당사의 플랫폼은 머신러닝 알고리즘을 사용하여 비디오 콘텐츠를 분석하고 진위 여부를 평가합니다.

서비스 제공:

• 무료 크레딧: 계정 등록 시 1회 무료 분석 크레딧
• 크레딧 패키지: 일회성 구매 가능 (Starter, Basic, Professional, Power, Enterprise)
• 크레딧은 만료되지 않음: 구매한 크레딧은 무기한 유효합니다
• 비디오 제한: 최대 10분 비디오, 500MB 파일 크기
• API 접근: 크레딧을 구매한 사용자에게 제공

중요: AiVidect가 제공하는 결과는 확률적 평가이며 절대적인 보장이 아닙니다. 중요한 결정에 당사 서비스에만 의존해서는 안 됩니다. 본 서비스는 정보 제공 목적으로만 제공됩니다.

3. 사용자 계정 및 책임

3.1 계정 등록: 특정 기능에 접근하려면 계정을 만들어야 합니다. 등록 시 정확하고 최신의 완전한 정보를 제공하는 데 동의합니다.

3.2 계정 보안: 귀하는 계정 자격 증명의 기밀성을 유지할 책임이 있습니다. 무단 접근이 있을 경우 즉시 당사에 알리는 데 동의합니다.

3.3 금지된 활동: 다음 행위는 금지됩니다:

• Upload, transmit, or analyze content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• 어떤 방식으로든 미성년자에게 해를 끼치기 위해 서비스를 사용
• 사용 또는 배포할 권리가 없는 콘텐츠를 업로드
• 훈련 데이터세트를 조작하기 위해 허위 피드백을 제출
• 서면 허가 없이 상업적 목적으로 서비스를 사용
• 소스 코드를 리버스 엔지니어링하거나 발견하려고 시도
• 허가 없이 자동화 도구를 사용하여 서비스에 접근
• 속도 제한 또는 사용 제한을 우회
• AiVidect와 경쟁하거나 유사한 서비스를 구축하기 위해 서비스를 사용

4. 크레딧 구매 및 청구

4.1 크레딧 패키지: 크레딧은 다양한 패키지로 일회성 구매가 가능합니다. 가격은 요금 페이지에 나열되어 있습니다.

4.2 크레딧 유효기간: 구매한 크레딧은 만료되지 않으며 계정에 남아 있습니다. 크레딧은 양도할 수 없습니다.

4.3 결제 처리: 모든 결제는 Stripe를 통해 안전하게 처리됩니다. 크레딧을 구매하면 청구를 승인합니다.

4.4 크레딧 사용: 각 동영상 분석은 1크레딧을 소비합니다. 크레딧은 분석 제출 시 차감됩니다.

4.5 추천 크레딧: 추천 프로그램을 통해 보너스 크레딧을 적립할 수 있습니다. 구매한 크레딧과 동일한 조건이 적용됩니다.

5. 환불 불가 정책

모든 판매는 최종입니다. 다음을 포함하되 이에 국한되지 않는 어떤 이유로도 환불되지 않습니다:

• 서비스 결과 또는 정확도에 대한 불만
• 구매한 크레딧을 사용하지 않음
• 본 약관 위반으로 인한 계정 정지 또는 해지
• 기술적 문제, 서비스 중단 또는 다운타임
• Change of mind or buyer's remorse
• 구매한 크레딧의 부분 사용
• 미사용 크레딧, API 호출 또는 기능

By purchasing any credit package, you explicitly acknowledge and agree to this No Refund Policy. We strongly encourage you to use your free credit before purchasing additional credits.

지불 거절: If you initiate a chargeback or payment dispute without attempting to resolve the issue with us first, we reserve the right to immediately terminate your account and pursue legal remedies to recover costs and damages.

6. 지적 재산권

6.1 AiVidect 자산: The Service, including all content, features, functionality, source code, algorithms, designs, and trademarks, is owned by AiVidect and is protected by international copyright, trademark, and other intellectual property laws.

6.2 귀하의 콘텐츠: You retain ownership of any content you upload to the Service. By uploading content, you grant us a limited license to process and analyze your content solely to provide the Service.

6.3 비디오 처리:

• 보관 없음: 업로드된 동영상은 처리 후 분석이 완료되면 즉시 삭제됩니다
• 저장 없음: 귀하의 동영상 사본을 저장, 보유 또는 보관하지 않습니다
• 훈련 데이터 없음: 동영상은 모델 훈련을 위해 수집되거나 사용되지 않습니다
• 개인정보: 귀하의 동영상 콘텐츠는 완전히 비공개로 유지되며 당사 서버에 저장되지 않습니다

분석 결과: 분석 결과는 성능 목적으로 캐시되고 기록 참조를 위해 계정에 연결될 수 있습니다.

7. 면책 조항 및 책임 제한

7.1 서비스 "있는 그대로": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 정확성 보장 없음: We do not guarantee the accuracy, reliability, or completeness of any analysis results. AI/ML systems can produce false positives and false negatives. You should not rely solely on our Service for critical decisions.

7.3 책임 제한: TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIVIDECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• 부정확한 분석 결과 또는 잘못된 판단
• 귀하의 전송 또는 데이터에 대한 무단 접근 또는 변경
• 서비스 중단 또는 오류
• 서비스를 통해 얻은 콘텐츠 또는 분석에 대한 의존

7.4 최대 책임: In no event shall AiVidect's total liability to you for all damages exceed the amount you paid to AiVidect in the six (6) months preceding the claim, or $100 USD, whichever is less.

8. 면책

You agree to indemnify, defend, and hold harmless AiVidect, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

9. 해지

9.1 귀하에 의한 해지: You may terminate your account at any time by contacting us or through your account settings. Upon termination, any unused credits will be forfeited.

9.2 당사에 의한 해지: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination by us for cause, you forfeit any remaining credits and no refund will be issued.

9.3 해지의 효과: Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnity, and limitations of liability.

10. 분쟁 해결 및 중재

10.1 비공식적 해결: Before filing a claim, you agree to contact us at support@aividect.com and attempt to resolve the dispute informally for at least 30 days.

10.2 구속력 있는 중재: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English in the United States.

10.3 집단소송 포기: YOU AND AIVIDECT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

10.4 예외: Either party may seek equitable relief in court for infringement of intellectual property rights.

11. 준거법 및 관할권

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.

12. 약관 변경

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

14.3 포기: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

14.4 양도: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.

14.5 불가항력: We shall not be liable for any failure to perform our obligations where such failure results from causes beyond our reasonable control.
