2. 服务说明

AiVidect提供AI驱动的视频分析和AI生成内容检测服务。我们的平台使用机器学习算法来分析视频内容并提供真实性评估。

服务内容:

• 免费信用: 账户注册时获得1次免费分析信用
• 信用套餐: 可一次性购买 (Starter, Basic, Professional, Power, Enterprise)
• 积分永不过期：购买的积分无限期有效
• 视频限制: 最长10分钟视频，500MB文件大小
• API访问: 适用于购买信用的用户

重要: AiVidect提供的结果是概率性评估，而非绝对保证。您不应仅依赖我们的服务做出关键决定。本服务仅供参考。

3. 用户账户和责任

3.1 账户注册: 要访问某些功能，您必须创建账户。您同意在注册时提供准确、最新和完整的信息。

3.2 账户安全: 您有责任维护账户凭证的机密性。您同意在发现任何未经授权访问时立即通知我们。

3.3 禁止活动: 您不得:

• Upload, transmit, or analyze content that is illegal, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
• 以任何方式使用本服务伤害未成年人
• 上传您无权使用或分发的内容
• 提交虚假反馈以操纵我们的训练数据集
• 未经书面许可将本服务用于商业目的
• 尝试对服务进行逆向工程或发现源代码
• 未经许可使用自动化工具访问本服务
• 规避速率限制或使用限制
• 使用本服务与AiVidect竞争或构建类似服务

4. 积分购买和计费

4.1 信用套餐: 积分可通过多种套餐一次性购买。价格列在我们的定价页面上。

4.2 信用有效期: 购买的积分永不过期，在使用前一直保留在您的账户中。积分不可转让。

4.3 支付处理: 所有付款均通过Stripe安全处理。购买积分即表示您授权我们收取费用。

4.4 信用使用: 每次视频分析将消耗一个积分。积分在提交分析时扣除。

4.5 推荐信用: 您可以通过推荐计划获得奖励积分。推荐积分与购买的积分适用相同条款。

5. 不退款政策

所有销售均为最终销售。任何原因均不予退款，包括但不限于:

• 对服务结果或准确性不满意
• 未使用已购买的积分
• 因违反这些条款而暂停或终止账户
• 技术问题、服务中断或停机
• Change of mind or buyer's remorse
• 部分使用已购买的积分
• 未使用的积分、API调用或功能

By purchasing any credit package, you explicitly acknowledge and agree to this No Refund Policy. We strongly encourage you to use your free credit before purchasing additional credits.

退款: If you initiate a chargeback or payment dispute without attempting to resolve the issue with us first, we reserve the right to immediately terminate your account and pursue legal remedies to recover costs and damages.

6. 知识产权

6.1 AiVidect财产: The Service, including all content, features, functionality, source code, algorithms, designs, and trademarks, is owned by AiVidect and is protected by international copyright, trademark, and other intellectual property laws.

6.2 您的内容: You retain ownership of any content you upload to the Service. By uploading content, you grant us a limited license to process and analyze your content solely to provide the Service.

6.3 视频处理:

• 无保留: 上传的视频在分析完成后立即处理并删除
• 无存储: 我们不会存储、保留或保存您视频的任何副本
• 无训练数据: 视频不会被收集或用于模型训练
• 隐私: 您的视频内容完全保密，永远不会存储在我们的服务器上

7. 免责声明和责任限制

7.1 服务"按原样"提供: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7.2 不保证准确性: We do not guarantee the accuracy, reliability, or completeness of any analysis results. AI/ML systems can produce false positives and false negatives. You should not rely solely on our Service for critical decisions.

7.3 责任限制: TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIVIDECT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• 未经授权访问或更改您的传输或数据
• 服务中断或错误

7.4 最大责任: In no event shall AiVidect's total liability to you for all damages exceed the amount you paid to AiVidect in the six (6) months preceding the claim, or $100 USD, whichever is less.

8. 赔偿

You agree to indemnify, defend, and hold harmless AiVidect, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• 您通过本服务上传或传输的内容

9. 终止

9.1 由您终止: You may terminate your account at any time by contacting us or through your account settings. Upon termination, any unused credits will be forfeited.

9.2 由我们终止: We reserve the right to suspend or terminate your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination by us for cause, you forfeit any remaining credits and no refund will be issued.

9.3 终止的影响: Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including intellectual property provisions, disclaimers, indemnity, and limitations of liability.

10. 争议解决和仲裁

10.1 非正式解决: Before filing a claim, you agree to contact us at support@aividect.com and attempt to resolve the dispute informally for at least 30 days.

10.2 有约束力的仲裁: If informal resolution fails, any dispute arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will be conducted in English in the United States.

10.3 集体诉讼弃权: YOU AND AIVIDECT AGREE THAT EACH PARTY MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A CLASS MEMBER IN ANY CLASS OR REPRESENTATIVE ACTION.

10.4 例外: Either party may seek equitable relief in court for infringement of intellectual property rights.

11. 适用法律和管辖权

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Delaware, and you hereby consent to personal jurisdiction and venue therein.

12. 条款变更

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on our website and updating the "Last Updated" date. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.

重大变更: For material changes (such as price increases or significant service modifications), we will provide at least 30 days' advance notice via email.
